Data Processing Agreement
This Data Processing Agreement forms part of the Terms of Service between Podflowww and customers using Podflowww for business purposes.
1. Purpose
This DPA explains how Podflowww processes personal data on behalf of business customers in accordance with applicable data protection laws.
2. Definitions
For this Agreement, Customer means the organization using Podflowww. Personal Data means information relating to an identified or identifiable individual. Processing means any operation performed on Personal Data.
3. Roles
For customer-uploaded data, Customer acts as the Data Controller and Podflowww acts as the Data Processor. Podflowww processes data solely on documented instructions from the Customer unless required by applicable law.
4. Categories of Data
Depending on customer usage, Podflowww may process user account information, email addresses, podcast research, podcast scripts, guest information, uploaded documents, audio, video, analytics, usage logs, and support communications.
5. Purpose of Processing
Processing occurs only for:
Delivering Podflowww services
AI-assisted podcast generation
User authentication
Customer support
Billing
Security
Performance monitoring
Fraud prevention
6. Confidentiality
All personnel authorized to process Personal Data are subject to confidentiality obligations.
7. Security Measures
Podflowww maintains appropriate technical and organizational safeguards including:
Encryption in transit
Access controls
Secure authentication
Infrastructure monitoring
Backup procedures
Security updates
8. Subprocessors
Podflowww may engage trusted subprocessors including providers for:
Cloud infrastructure
Authentication
Payment processing
AI services
Analytics
Customer support
Podflowww remains responsible for ensuring subprocessors provide appropriate data protection.
9. International Transfers
Customers may request assistance regarding:
Access requests
Data correction
Data deletion
Data portability
Processing restrictions
Podflowww will provide reasonable assistance where legally required.
10. Customer Rights
Customers may request assistance regarding access requests, data correction, data deletion, data portability, and processing restrictions. Podflowww will provide reasonable assistance where legally required.
11. Data Breach Notification
If Podflowww becomes aware of a confirmed Personal Data breach affecting Customer Data, we will notify affected customers without undue delay as required by applicable law.
12. Data Retention & Deletion
Customer data is retained only as long as necessary to provide the Service or comply with legal obligations. Upon termination of the Service, data may be deleted or anonymized in accordance with our retention practices, unless retention is required by law.
13. Audits
Where required by applicable law or agreed contractually, Podflowww may provide reasonable information demonstrating compliance with this DPA, subject to appropriate confidentiality protections.
14. Liability
Liability under this DPA is subject to the limitations set out in the Podflowww Terms of Service, except where prohibited by applicable law.
This DPA shall be governed by the laws specified in the Podflowww Terms of Service, unless otherwise required by applicable data protection legislation.
